The UCMJ(Uniform Code of Military Justice) applies to all regardless of your rank! The Skipper played by Gene Hackman was relying on the loyalty of his men to countermand the higher authority of military law for which Commander Hunter(Denzel Washington) was trying to uphold.
He was also trying prevent the greater catastrophe of Nuclear holocaust. Note the great scene in which Commander Hunter quotes Von Clauswitz. Also check the great 1960s movie The Bedford Incident and you may see the parallels between Gene Hackman's submarine captain and Richard Widmark's Captain Finlander.
