Historical fact, Mary Suratt received the ultimate punishment for her role in the Lincoln assassination. Her son, John Suratt, who was captured 1+ years later was acquited. Fodder for a movie on military tribunals, justice meted out for conspirators first caught versus later.
Since this is a movie and not a documentary Redford is free to make his case for the injustice whether he has to create his own facts. If John Suratt had been captured with his mother he likely would have hanged.
The movie captures the tenor of the times which lead to the differing decisions for mother vs. son.
